1. Introduction
Welcome to the Touch! These Terms of Service and User Agreement (the "Agreement") constitute a legally binding agreement between you and the Touch ("we," "our," or "us"). By using the Touch, you agree to comply with and be bound by these terms.
2. Eligibility
You must be at least 18 years old to use our platform. By accessing or using the Touch, you affirm that you are eligible to do so.
3. User Responsibilities
You are responsible for your actions and the content you create and share on the Touch. We expect all users to respect one another and adhere to our community guidelines, which are outlined separately.
4. Content Usage
- User-Generated Content: You retain ownership of the content you create and share on our platform. However, you grant the Touch a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display your content for the purpose of operating and promoting the Touch.
- Intellectual Property: Respect the intellectual property rights of others. Do not upload or share content that infringes upon copyrights, trademarks, or other intellectual property rights without proper authorization.
5. Payments and Revenue Sharing
Users, including creators and companions, may have the opportunity to earn money on our platform. Specific details regarding payments, revenue sharing percentages, and payout methods are outlined in our separate Payment and Revenue-Sharing Agreement, which you must also agree to.
6. Termination
We reserve the right to suspend, terminate, or restrict your access to the Touch if you violate these terms, our community guidelines, or for other reasons as deemed necessary. You may also terminate your account at any time by following our provided procedures.
8. Limitation of Liability
- No Warranty: The Touch is provided "as is" without any warranties, either expressed or implied. We do not guarantee the accuracy, reliability, or availability of our platform.
- No Liability: The Touch is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Touch or any content on it.
9. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Colombia. Any disputes arising from this Agreement will be resolved through binding arbitration in accordance with the rules of the Colombia Arbitration Institution. Each party will bear its own costs associated with arbitration.
10. Changes to Agreement
We reserve the right to modify this Agreement at any time. We will notify users of material changes, and your continued use of the Touch after such notification constitutes your acceptance of the revised Agreement.
